End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("End-User") and Dube GmbH ("Licensor", "we", "us", or "our") for the use of the ProductScan AI mobile application ("Licensed Application").

By downloading, installing, or using the Licensed Application, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, do not download, install, or use the Licensed Application.

1. Acknowledgement

This Agreement is concluded between you and Dube GmbH only, and not with Apple Inc. ("Apple"). Dube GmbH, not Apple, is solely responsible for the Licensed Application and its content. Although Apple is not a party to this Agreement, Apple has the right to enforce this Agreement against you as a third-party beneficiary.

2. Scope of License

Dube GmbH grants you a limited, non-transferable, non-exclusive, revocable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use the Licensed Application on any device that you do not own or control, and you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time.

You may not rent, lease, lend, sell, redistribute, or sublicense the Licensed Application. You may not copy (except as permitted by this license and the Usage Rules), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof.

If the Licensed Application is provided with Family Sharing enabled, it may be used by family members associated with your Apple ID account, subject to the terms of Family Sharing as set forth in the Apple Media Services Terms and Conditions.

3. Maintenance and Support

Dube GmbH is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this Agreement or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application. To the extent that any maintenance or support is required by applicable law, Dube GmbH, not Apple, shall be obligated to furnish any such maintenance or support.

4. Warranty

The Licensed Application is provided "as is" and "as available" without warranty of any kind. Dube GmbH disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Dube GmbH's sole responsibility.

5. Product Claims

Dube GmbH, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

6. AI-Generated Content

All content provided by the Licensed Application — including product analyses, scores, descriptions, chat responses, and any other information — is generated by artificial intelligence and may not be factually accurate, complete, or up to date. AI models can produce incorrect, misleading, or fabricated information (commonly known as "hallucinations").

You should not rely on any information provided by the Licensed Application as a substitute for professional advice, including but not limited to medical, nutritional, legal, or financial advice. Always verify critical information from authoritative sources before making decisions based on it.

7. Intellectual Property

In the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, Dube GmbH, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

8. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

10. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Licensed Application. This includes, but is not limited to, your wireless data service agreement and any applicable usage rules set forth by Apple in the Apple Media Services Terms and Conditions.

11. Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

12. Account Deletion

You may delete your account at any time through the account settings in the Licensed Application. Upon deletion, all your personal data, scan history, chat conversations, and any other data associated with your account will be permanently and irreversibly deleted from our systems.

If you have an active subscription, please cancel it through your Apple ID settings (Settings > Apple ID > Subscriptions) before deleting your account. Deleting your account does not automatically cancel your subscription, and you may continue to be charged until the subscription is cancelled separately.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
